The Courts/Public Safety Committee met on September 2, 2008, it was recommended and I move:

CPS08/09 - 41 To approve the contract with Western Michigan University in the amount of $25,068.68 to evaluate the outcomes of the interventions/diversion from the jail assessment and screening center and authorize the Board Chair to sign the agreement. Funding from the Edward Byrne Memorial Justice Assistance Grant Program will reimburse the County of Muskegon for the full contract.

CPS08/09- 42 To approve acceptance of the grant for funding under the Edward Byrne Memorial Justice Assistance Grant Program in the amount of $335,381.00 for the jail assessment and screening center pilot initiative, establish the budget and authorize the Board Chair to sign the agreement.

CPS08/09 - 43 To waive the hiring freeze and allow the Circuit Court, Family Division to fill the vacant Juvenile Supervisor position #X47302.

CPS08/09 - 44 To authorize the Circuit Court Administrator to sign an amended Memorandum of Understanding between the Circuit Court - Family Division of Muskegon County and the United Way of the Lakeshore concerning the donation of monies to the County Child Care Fund and the transfer of $31,000 to the County of Muskegon to be used as local match for state Child Care Fund monies.

CPS08/09 - 45 To authorize the Circuit Court Administrator to sign an amended Memorandum of Understanding between the Circuit Court - Family Division and the United Way of the Lakeshore concerning the donation of monies to the Muskegon County Child Care Fund in the amount of $50,000 to be used as local match for the state Child Care Fund monies.

CPS08/09 - 46 To authorize the Circuit Court Administrator to sign a Memorandum of Understanding between the Circuit Court - Family Division and the Child Abuse Council of Muskegon County concerning Court Appointed Special Advocate (CASA) program requirements; and to further approve a revised FY2008 budget of $32,000 from the CASA (2920-1433) program which includes the 50% local match coming from United Way of the Lakeshore ($16,000) resulting in no impact to the general fund.

CPS08/09 - 47 To authorize the Circuit Court Administrator to sign an amended Agreement for Mediation Services between the Circuit Court - Family Division of Muskegon County and the Westshore Dispute Resolution Center of Muskegon County with effective dates of October 1, 2008 through September 30, 2009 concerning the Balanced and Restorative Justice (BARJ) program requirements.

CPS08/09 - 48 To approve the FY 2009 Child Care Fund Annual Plan and Budget and authorize the Board Chair to sign the document for submission to the State of Michigan.

CPS08/09 - 49 To authorize the Chair to sign the 2009 Title IV-D Cooperative Reimbursement Program application in the amount of $2,251,137.

CPS08/09 - 50 To grant permission to the Sheriff’s Office to submit the annual application to the Office of Highway Safety Planning for Secondary Road Patrol for 2008/2009 in the amount of $213,362.00, State’s allocation of $193,980.00 and General Fund match of $19,382.00.

CPS08/09 - 51 To renew the agreement with David H. Deitrick, MD for medical services at the county jail at the rate of $2,100 per month for October 1, 2008 to September 30, 2009.

CPS08/09 - 52 To accept the Region Six Memorandum of Understanding Use of City Watch and City Net between Homeland Security Region 6 and the County of Muskegon on behalf of the Sheriff Department/Emergency Services, and direct the Board Chair and appropriate staff to sign the Memorandum of Understanding.

CPS08/09 - 53 To authorize the Board Chair to accept the FY 2008 Homeland Security Grant Emergency Management Performance Grant from State of Michigan on behalf of the Muskegon County Sheriff Department/Emergency Services in the amount of $38,630.00.

CPS08/09 - 54 To authorize the Prosecutor to accept the FY20090 Crime Victims Rights funding agreement in the amount of $155,000 from the Crime Victim Services Commission and to affix the signature of the Chairman of the Board to two copies of the agreement.

CPS08/09 - 55 To approve the Prosecutor’s FY2009 Cooperative Reimbursement Agreement in the amount of $323,172, with the State share of $213,294 or 66% and the County share of $109,878 or 34% and to affix the signature of the Chairman of the Board to two copies of the agreement.

CPS08/09 - 56 To schedule a Board Planning Session of the Muskegon County Board of Commissioners, to discuss the 2009 draft budget and the Interim Administrator position, on Thursday, September 4, 2008, at 11:30 a.m., South Campus, Training Center, 133 East Apple Avenue, Muskegon.


The Human Resources Committee met on September 2, 2008, it was recommended and I move:

HR08/09 - 61 To authorize the Muskegon County Health Department to contract with Access Integrated Technologies, Inc., in the amount of $6,000.00 to air public service announcements at local theaters to increase awareness and understanding of the impact of second hand smoke exposure.

HR08/09 - 62 To authorize the adoption of the Resolution, entitled Distribution of Michigan Convention Facility Development Fund (PA2 Funds) for the purpose of allocating those funds received by the County of Muskegon.

HR08/09 - 63 To authorize the Health Department to contract with Great Lakes Removal for the removal of human remains for the Medical Examiner Program from October 1, 2008 through September 30, 2009 and further authorize the Board Chair to sign that associated agreement.

HR08/09 - 64 To authorize the Health Department to enter into an agreement with Access Health, Inc., in the amount not to exceed $246,000, for the delivery of health care related services for indigent and low-income residents of Muskegon County for the 2008-2009 fiscal year. Further move to authorize the Board Chairman and the Director of Health and Community Resources to sign the agreement.

HR08/09 - 65 To authorize Community Mental Health Services of Muskegon County to accept the proposed rate changes by those vendors/providers listed in Attachment A: FY 2008/2009 Proposed Vendor Rate Changes, effective October 1, 2008 through September 30, 2009.

HR08/09 - 66 To authorize the Community Mental Health Director to sign a contract with those service vendors/providers who have submitted written agreements to continue service provision at the current Fiscal Year 2007/2008 rates for the time period effective October 1, 2008, through September 30, 2009.

HR08/09 - 67 To authorize the Community Mental Health Director to sign a contract with the following agencies for these additional services effective October 1, 2008 through September 30, 2009, at the identified rates: Disability Connection - Community Living Supports at a rate of $4.61 per 15 minute unit, with a cap of $8,000; Unified Health Partners - In-Home Nursing Care at a rate of $7.92 RN per 15 minute unit, $11.76 RN Holiday per 15 minute unit, $6.58 LPN per 15 minute unit and $9.88 LPN Holiday per 15 minute unit with a cap of $8,000.00.

HR08/09 - 68 To authorize Community Mental Health Services of Muskegon County to apply for renewal funding from the Department of Housing and Urban Development for rental assistance and administrative costs in the amount of $44,150 through the 2008 HUD SuperNofa, Continuum of Care Program for permanent supportive housing with CMHS of Muskegon County providing $40,000 in supports as the in-kind match.

HR08/09 - 69 To authorize Community Mental Health Services of Muskegon County to apply for renewal funding from the Department of Housing and Urban Development for rental assistance and administrative costs in the amount of $99,112 through the 2008 HUD SuperNofa, Continuum of Care Program for permanent supportive housing with CMHS of Muskegon County providing $91,000 in support as the in-kind match.

HR08/09 - 70 To authorize Community Mental Health Services of Muskegon County to apply for funding from the Department of Housing and Urban Development for rental assistance and administrative costs in the amount of $15,989 through the HUD SuperNofa, Continuum of Care Program for permanent supportive housing with CMHS of Muskegon County providing $14,370 in supports as the in-kind match.

HR08/09 - 71 To authorize the Community Mental Health Director to sign a contract with Community Health of Branch County and Hillsdale Community Mental Health Center for Adult Inpatient Services, effective October 1, 2008 through September 30, 2009, at the per diem rate of $594.00 and $625.00 respectively.

HR08/09 - 72 To authorize the Public Health Department of Muskegon County to put out for bids the services of Medical Examiner.


The Ways and Means Committee met on September 4, 2008, it was recommended, and I move:

WM08/09 - 130 To approve payment of the accounts payable of $7,160,352.72 covering the period of August 13, 2008 through August 29, 2008, as presented by the County Clerk.

WM08/09 - 131 To amend the FY2008 General Fund revenue budget from $47,691,190 to $45,308,560 and the General Fund expenditure budget from $47,690, 136 to $45,308,560, the All Funds revenue budgets from $248,833,110 to $259,672,233 and the All Funds expense budgets from $255,230,480 to $259,191,456.

WM08/09 - 132 To authorize intergovernmental transfers to the State of Michigan of General Fund dollars with other qualifying dollars, with the total not to exceed $241,000, and to commit those funds to increase health care funding in the community to support Indigent Care Agreements-based DSH payments to community hospitals. This is the State of Michigan Disproportionate Share Hospital Program (DSH).

WM08/09 - 133 To adopt and approve the MERS HCSP Savings Program Uniform Agreement and Participation Agreements for the MNA Health Department Nurses, AFSCME Brookhaven and Teamsters District Court Units for the VEBA type plan approved in the labor agreements for retiree health care for new hires.

WM08/09 - 134 To approve a fee of $10 for marriage license waivers to all local and non-military applicants.

WM08/09 - 135 To approve certified copy rate increase for the Clerk’s office to $15 for the first copy and $5 for each additional copy of the same record purchased at the same time, effective October 1, 2008.

WM08/09 - 136 To authorize a proposal to be developed to accept bids from professional, nation-wide search firms to fill the permanent County Administrator position.
